Membership is only available to persons who can form legally binding contracts by law. Minors are prohibited from using our service, as are individuals whose membership we have suspended (during such suspension), or terminated. You agree to have only one Eggschange Nickname or User ID, and any
instances of individuals procuring or attempting to procure more than one membership with eggschange
may result in the termination of excessive or all user accounts.

2. Information that you provide to us |

Information that you provide shall be treated in accordance with our
privacy policy.
Information that you provide to Eggschange or other members, whether through registering, bidding, listing items or email shall be subject to certain regulations:
- You agree not to provide any false or misleading information, including your name and identity and not to infringe any third party copyright, patent, trademark or other intellectual property.
- You further agree not to provide information in order to engage in any unlawful activity, including the sale of counterfeit or stolen items.
- You agree that information submitted shall not contain any computer viruses or Trojan horses that are intended to cause material damage or intercept information to Eggschange or any other Eggschange member.
In particular, you must provide a valid email address for your account. If we cannot reach you via the email
address of record for your account, we will suspend your account until such time as we can reliably
contact you via email. If you change your email address, you must change your email account of record
by editing your details in your Personal Pages.
Any breach herein will be cause for the user to be suspended or terminated, at the sole discretion of
Eggschange. If your account is suspended, you may contact
Customer Service in order to investigate the cause and
determine the steps you need to take to have your account reactivated.

3. Bidding and Winning an Auction |
|
|
|
|
|
|
|
|
|
|
|

If you are the highest bidder in a completed auction, and have met the minimum or reserve price, you are obligated to complete the transaction with the auction lister. When you place a bid on an item, you agree to be bound by the terms of sale as delineated in the seller’s auction listing, as long as those terms do not violate this user agreement, and are not unlawful. You are strongly urged to ask any questions you may have regarding an item, including requests for clarification of the auction listing, BEFORE you bid on the auction. Once you have bid, you have agreed to complete the transaction, even if an auction listing was unclear, or you did not understand it.
Eggschange does not accept any obligation to warranty the safety of any item
sold on the website. Do not assume that any item is safe because it listed for auction on
Eggschange.

4. Listing and Selling an Item |
|
|
|
|
|
|
|
|
|
|
|
| |
You are required to describe your item(s)and delineate all terms of sale in your auction listing. You may use item descriptions, pictures, and graphics, but the content must be relevant to the sale of those items. You will be obligated to complete the transaction with the highest bidder (who has met or exceeded the reserve price, if one has been specified by you), unless the highest bidder does not meet the terms of the sale (i.e., does not make payment to you in accordance with the terms of sale set forth in the auction listing).
Eggschange has a written policy for dealing with high bidders that refuse to complete an auction transaction. The details may be found here <link>.
Eggschange may suspend or terminate your usage of the site if we suspect
that you are using the site to engage in any fraudulent activity.
You agree not to offer or sell any item on Eggschange that:
- contains any content, whether written, graphic or photographic, of an adult or sexually explicit nature;
- are firearms, knives or could be considered offensive weapons of any sort, or;
- is a dangerous item, or of such condition that it is likely to produce harm to any property or person.

It is not always easy to authenticate the identity of someone that you are doing business with over the internet. For this reason, Eggschange has incorporated a system that allows individuals
to report to others about their satisfaction in transactions with others.
Since members will rely on the feedback in deciding whether to bid on an auction, and potentially transact business with a member, Eggschange considers it imperative that no member attempt
to undermine the integrity of the feedback system. Feedback can only be placed by members that have completed an auction with one another. This means that a member cannot leave feedback for him or herself, whether directly under their own Nickname or User ID, another Nickname or User ID or a third party’s membership. Any member that attains a net –3 feedback rating will have their membership suspended or terminated at Eggschange’s discretion.
Feedback is permanent and cannot be altered once left; you are strongly encouraged to try and work with the other party in order to resolve any difficulties prior to leaving any negative feedback.

6. Interference with the website |
|

|
|
|
|
|
|
|
|
|

All users agree that they will not undertake any action, or ask and third party to undertake any action, that results in the interference of the operation of the Eggschange website.
|

Becoming a member of Eggschange and bidding on auctions are both free.
Sellers pay fees to list and sell items, as delineated on our schedule of fees, and according to the timetable shown in our fee payment schedule.
Any changes to the fee
structure or the fees themselves will be posted on our Eggschange
News page, and will be effective 21 days from the date of such posting. The fees associated with an auction listing are shown on the listing page, and you will therefore have the opportunity to review such fees at the time the auction is listed. Sellers are responsible for paying all fees associated and any tax liability as may occur with using Eggschange.

You accept sole responsibility for the legality of your actions when using
Eggschange. This website is provided with absolutely no warranties, express or implied. If you are a consumer, your statutory rights are not affected. You agree to hold
Eggschange, and its principals, harmless for any claim made
by any party. You further agree that Eggschange is not responsible for any losses which may occur as a result of internet failures of any kind, or technical malfunctions.

9. Eggschange's role in any transaction that occurs through the use of this site |
|

The Eggschange website facilitates the meeting of members who wish to list items for sale, and for buyers who wish to offer to bid on and purchase them. Because we are not directly involved in any transaction, it is impossible for us to control the accuracy of auction listings, and the quality and safety of items offered for sale. We are unable to guarantee that a transaction will actually occur as a result of an auction listing, or winning bid. We encourage you to use common sense and precaution in all of your transactions on
Eggschange, as you bear any risks associated with doing so. We are not responsible for the actions that are taken by sellers and bidder, whether intentionally, or unintentionally. We are not responsible for typographical errors in auction listings nor misrepresentations. Any use of Eggschange is made at your own risk.

Shill bidding is a bid or bids placed by the seller himself, or friend, family member or other representative of the seller in order to drive up the bidding price of an auction. Shill bidding is not allowed on
Eggschange, and individuals attempting to engage in it will be terminated as users at the sole discretion of
Eggschange.

11. Amendments to this agreement |
|
|
|
|
|
|
|
|
|
|
|
| |
This user agreement may be amended from time to time, and amendments will be effective three days from the day amended. Amendments will be posted under the news and information area on the
home page.
